The Waste Electrical and Electronic Equipment directive (2002/96/EC), as transposed by LN 63 of 2007, implements the PRP for waste electrical and electronic equipment.
This legislation applies to all electrical and electronic equipment put on the market in Malta.
To "put on the market" means when electrical and electronic equipment is supplied or made available, whether in return for payment or free of charge, to a third party in Malta and includes import into the customs territory of Malta; and "putting a product on the market" shall be construed accordingly.
It also important to note that producers who manufacture or import electrical and electronic equipment goods for their own consumption (e.g. for their own manufacturing processes) are still obliged to register as producers.
A producer of electrical and electronic equipment is defined as any person who, irrespective of the selling technique used, including by means of distance communication:
(i) manufactures and sells electrical and electronic equipment under his own brand, or
(ii) resells under his own brand equipment produced by other suppliers, a reseller not being regarded as the producer if the brand of the producer appears on the equipment, as provided for in paragraph (i), or
(iii) imports electrical and electronic equipment on a professional basis into Malta.
Producers who are obligated under Waste Electrical and Electronic Equipment regulations must register with the MALTA ENVIRONMENT AND PLANNING AUTHORITY.
For this reason, each producer is to register every year with the MEPA and is to provide the Competent Authority with the necessary information for the previous year as required in the application for registration.

When a producer ceases to put electrical and electronic equipment on the market he shall inform the Competent Authority within 20 working days of his ceasing to do so. Where the business of a producer is transferred in whole or in part to another person, the producer shall be treated as remaining responsible for electrical and electronic equipment in respect of which he has made an application unless he is able to demonstrate that the person to whom the transfer has been made has agreed to meet the producer's obligations of any electrical and electronic equipment under these obligations.
The Competent Authority will provide advice and answer specific queries on the Waste Management (Waste Electrical and Electronic Equipment) Regulations, L.N. 63 of 2007. Enforcement action and prosecution may be taken against any company which avoids its obligations e.g. by not registering or joining a scheme by the due date, by not taking reasonable steps to meet its recovery and recycling obligation, and/or by providing inaccurate data.
